NGT impose Rs 25 crore fine on Vedanta's Odisha plant for green violations

Tags: Science and Technology

The National Green Tribunal (NGT) has imposed a fine of Rs 25 crore on the Anil Aggarwal Company Vedanta limited for violating the environmental norms by expanding its plant at Lanjigarh in Odisha's Kalahandi district.

A case was filed in the NGT by the environmental activist Prafulla Samantra against the environmental clearance granted to Vedanta in November 2015 for expansion of its alumina refinery and captive power plant in Lanjigarh.

Background to the Case

  • Vedanta was granted environmental clearance by the  Union Ministry of Environment, Forests and Climate change in September 2004 for its 1 million tonne per annum alumina refinery with a 75MW captive power plant in Lanjigarh.
  •  However the company without the permission of the ministry increased the capacity of the plant from 1 million tonne per annum to 6 million tonne and captive power plant from 75MW to 285MW at an expenditure of about Rs 4,000 crore.

NGT verdict

  • The NGT held the Vedanta Company guilty of violating the Environmental Impact Assessment notification 2016 which made environmental clearance necessary before expansion of a polluting industrial plant.
  • Invoking the polluters pay principle, NGT ordered the company to pay Rs 25 crores to the Odisha State Pollution Control Board within a month. The money will be used by the Odisha State Pollution Control Board for planting of trees and restoration of the environment.

Polluter Pay Principle

  • The Polluter Pays Principle imposes liability on a person who pollutes the environment to compensate for the damage caused and return the environment to its original state regardless of the intent.
  • In India according to section 20 of the National Green Tribunal Act 2010, the tribunal can apply for the principles of sustainable development, the polluter pays principles and precautionary principle while passing any order, award or decision for balanced development without harming the mother earth.

National Green Tribunal

  • It deals with cases relating to the environment protection and conservation of forest.
  • It was set up in 2010 under the National Green Tribunal Act 2010.
  • The Tribunal is not bound by the procedure laid down under the Code of Civil Procedure, 1908, but is  guided by principles of natural justice.
  •  New Delhi is the Principal Place of Sitting of the Tribunal and Bhopal, Pune, Kolkata and Chennai are other four places of sitting of the Tribunal.
