SC Dissolves CoA, orders AIFF's constitution to be revised in accordance with FIFA rules

The Supreme Court on 22 August 2022, ordered the dissolving of its committee of administrators (CoA) that has been overseeing the day-to-day functioning of the All India Football Federation (AIFF).

This move of the Supreme Court is seen as an attempt to overturn the ban imposed by world football governing body FIFA which suspended AIFF for “undue influence from third parties”.

Background to the issue

  • On 18 May 2022, the Supreme Court dismissed Praful Patel as the president of AIFF for not holding an election in the AIFF which was due in 2020.
  • It appointed a three-member Committee of Administrators (CoA), headed by former top court judge AR Dave, to manage AIFF.
  • The CoA was to frame a new constitution for AIFF according to the National Sports Code.

FIFA Bans AIFF

  • On 16 August FIFA suspended AIFF and the country has also been suspended from hosting the 2022 Under-17 Women's World Cup, scheduled for October 2022.
  • FIFA viewed the Supreme Court appointed Committee which managed the AIFF as an  “"undue influence from third parties"  and suspended AIFF  as it was against FIFA statute .
  • It also banned India from hosting any International football tournament and banned the participation of the Indian national and club team in participating in any international tournament.
  • However FIFA had said that if the third party influence was removed then India can still hold the 2022 Under-17 Women's World Cup.

Government moves Supreme Court

  • The Government of India moved the Supreme Court to reconsider its decision so that FIFA can lift the ban and India can host the Under-17 Women's World Cup 2022 as per schedule.
  • It requested the Supreme Court to end the tenure of the Committee of Administrators (CoA) and direct that the day-to-day management of the AIFF shall be looked after by the AIFF administration led by the acting Secretary General.

Supreme Court Judgement

  • A Justice bench consisting of D.Y. Chandrachud and A.S. Bopanna dissolved the CoA and ordered the administration led by the Secretary General of AIFF to look into the day-to-day matters of the AIFF.
  • Also it said that the AIFF constitution should be revised in accordance with FIFA and ordered the AIFF to hold an election within one week.
  • It is hoped that after the Judgment of the court, FIFA will lift the ban on AIFF and India can still host the 2022 Under-17 Women's World Cup.
