Supreme Court direct Madhya Pradesh poll body to hold local body poll

Tags: State News

The Supreme Court has directed the Madhya Pradesh State Election Commission to conduct the pending election to the local bodies in the state as it cannot skip its constitutional obligation.

  • Delivering judgment in the Suresh Mahajan Vs State of Madhya Pradesh 2022 case a bench of justices AM Khanwilkar, AS Oka, and CT Ravikumar said that the state has a constitutional obligation to conduct local body polls after the completion of 5 years term of the local bodies.
  • The court found that besides 23,000 rural local bodies, polls had not been held in 321 urban local bodies in Madhya Pradesh since 2019-2020.
  • Under the 73rd and 74th constitutional amendment act 1992, the election to the Panchayats and Municipalities respectively has to be conducted after every five years and within six months after the terms of a local body ends.
  • The Supreme Court also said that the state election body has to notify the polls within two weeks of the judgment.
  • The court also said that there will be no reservation for Other Backward classes in the local body polls unless the state follows the triple test laid down for such reservation by the Supreme Court in the Vilas Krishnarao Gawli vs State of Maharashtra 2021.

 In the Gawli case the Supreme Court had provided a triple test benchmark for states in determining OBC quota in local body elections. The three tests are:

“1) to establish a dedicated commission to conduct contemporary rigorous empirical inquiry into the nature and implications of backwardness in the form of local bodies within the state;

 2) specify the proportion of reservations required for provision of local bodies. In the light of the recommendations of the Commission,

 3) In no case such reservation shall exceed 50% of the total number of seats reserved in favour of SC/ST/OBC.

  • According to the 73rd and 74th Constitutional amendment 1992 the State government can provide for 27% reservation of seats for the OBC in the Panchayats and Municipalities respectively.
  •   It is to be noted that local body election is conducted by the respective State Election Commission and not by the Election Commission of India.
